General terms and conditions Kooistra.com BV

The following general conditions apply to all agreements concluded between Kooistra.com BV and its buyers, as well as to orders placed via the Kooistra.com BV webshop.

Article 1 - Definitions

Copper: The person with whom Kooistra.com BV concludes purchase agreements or is negotiating such an agreement.

Seller: Kooistra.com BV in Leeuwarden.

Products: The goods sold or potentially to be sold by Kooistra.com BV.

Agreement: Any agreement for the sale of products concluded between the buyer and Kooistra.com BV, including all (legal) acts in preparation and execution of that agreement.

Article 2 - Applicability

These conditions apply to all quotations, offers and agreements of Kooistra.com BV with buyers. Deviations are only valid if agreed in writing and signed by both parties. If any part of these conditions is contrary to mandatory legislation, the remaining provisions shall remain valid and the conflicting provision shall be replaced by a new one that is as close as possible to the purpose and purport of the original provision.

Article 3 - Formation of the Agreement and Prices

3.1 All quotations and offers from Kooistra.com BV are without obligation, unless otherwise stated. The agreement is concluded by written confirmation of an order or by execution of the agreement.

3.2 All prices do not include VAT and any shipping costs unless otherwise indicated. Prices including VAT and shipping costs are automatically calculated in the shopping cart during checkout.

3.3 Kooistra.com BV reserves the right to adjust prices in the event of changes in cost-determining factors. A price change of more than 15% gives the buyer the right to dissolve the agreement.

Article 4 - Delivery and Delivery

4.1 Orders via the webshop will be delivered within 3-7 working days, subject to unforeseen circumstances. Exceeding the delivery time does not give a right to compensation or dissolution, unless the delay is such that the buyer cannot reasonably be required to maintain the contract.

4.2 Kooistra.com BV reserves the right to cancel all or part of an order in the event of stock shortages or other reasons. Any cancelled charges will be refunded. A cancellation does not entitle you to compensation.

4.3 Delivery shall be ex warehouse, unless otherwise agreed. In the case of home delivery, Kooistra.com BV shall determine the method of transport. From delivery onwards, the buyer is responsible for loss or damage to the products.

Article 5 - Payment

Payment can be made in the following ways:

-Cash on collection (no shipping costs).

-Bank transfer (IBAN: NL23ABNA0416168655, BIC: ABNANL2A) stating the order number.

-PayPal, Bancontact/Mister Cash, SOFORT Banking, iDEAL.

5.1 Payment must be made within fourteen days of the invoice date. If payment is not made, the buyer is legally in default and Kooistra.com BV may dissolve the agreement and sell the products to a third party.

Article 6 - Retention of title

All products shall remain the property of Kooistra.com BV until full payment, including any interest and costs, has been made. The buyer is not permitted to encumber or process the products until ownership has been transferred in full.

Article 7 - Returns and cancellations

7.1 Orders can be cancelled free of charge on the day of ordering via email. After sending the order, cancellation will charge 20% of the net order amount. Refunds require the same bank account as the one used to make the payment.

Article 8 - Defects and liability

8.1 Buyer must check the products for defects upon delivery. Immediately visible defects must be reported in writing within eight days. Other defects must be reported within one month of delivery. These deadlines are final and exceeding them excludes a claim for defects.

8.2 Kooistra.com BV excludes liability for damage resulting from the use of the products delivered, except in the event of intent or deliberate recklessness on the part of Kooistra.com BV. Liability is limited to the invoice amount of the relevant agreement or the amount paid out by the liability insurance.

Article 9 - Force majeure

In the event of force majeure, Kooistra.com BV may suspend delivery or dissolve the agreement in whole or in part without any obligation to pay damages. Force majeure includes any circumstance beyond the control of Kooistra.com BV that makes delivery impossible.

Article 10 - Amendments to General Terms and Conditions

The latest version of these conditions always applies from the moment an agreement is concluded. Kooistra.com BV reserves the right to change these terms and conditions.

Article 11 - Applicable law and dispute resolution

All agreements are governed by Dutch law, to the exclusion of the Vienna Sales Convention. Disputes shall be submitted to the competent Dutch court in the place of business of Kooistra.com BV.
